Terms of Service

1. Acceptance

By downloading, accessing, or using the Unspiral iOS app, Movie Mode, or our website (the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. The Unspiral iOS app is also licensed to you under Apple's Standard End User License Agreement, which governs your licence to the app itself. These Terms sit alongside it and cover our services more broadly.

2. Who may use Unspiral

You must be legally able to enter into this agreement. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you.

3. Limited license

Subject to these Terms, Unspiral grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the app on Apple-branded devices you own or control, as permitted by the App Store usage rules. You may not copy, sell, rent, sublicense, reverse engineer, interfere with, or create derivative works from the Services except where applicable law expressly permits it.

4. What Unspiral does

Unspiral offers quieter interfaces for certain third-party websites and uses Apple's Screen Time frameworks to apply app restrictions you select. Features depend on iOS permissions, third-party website behavior, network access, and device settings.

Unspiral is a wellbeing tool, not an emergency, medical, parental-control, or safety service. You are responsible for choosing appropriate settings and confirming that a restriction behaves as expected before relying on it.

5. Breaks and Locked In

An ordinary break may be ended through controls made available by Unspiral or iOS. If you turn on Locked In and confirm a break, the selected apps may remain restricted until the displayed end time, and Unspiral intentionally does not provide an early-exit control. Review the duration and selected apps before confirming.

Operating-system behavior can change, and restrictions may fail, persist, or end unexpectedly. Unspiral provides reset tools for restrictions it can identify, but cannot guarantee control over restrictions created by iOS, prior app versions, or other apps.

6. Movie Mode

Movie Mode lets a host create a room and invite others to synchronize an app break. Joining a room is not consent to start a break. A participant must tap Ready, and must confirm again if the host changes an ordinary break to Locked In.

Room codes are shareable access codes. Share them only with people you intend to invite. Do not impersonate others, disrupt rooms, attempt to access rooms without permission, or use Movie Mode for harassment, coercion, or unlawful activity.

7. Subscriptions and billing

Unspiral requires a paid auto-renewing subscription. There is no free tier. Two plans are offered as in-app purchases through the App Store:

• Unspiral Annual, US$29.99 per year, including a two-week free trial for Apple Accounts that have not already used it; and
• Unspiral Monthly, US$4.99 per month, billed from the first day.

Prices in other territories are set by Apple's pricing tiers and are shown in your local currency before you buy. Payment is charged to your Apple Account when you confirm the purchase.

A subscription renews automatically at the same price and for the same period unless it is canceled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the end of that period. Manage or cancel a subscription at any time in your Apple Account settings; deleting the app does not cancel it.

If you buy a subscription while a free trial is running, the unused portion of the trial is forfeited. Refunds are handled by Apple under the App Store's refund policy, not by us.

We may change prices or plans for future periods. Where required, we will give you notice and the chance to cancel before a changed price takes effect.

8. Third-party services and content

Unspiral can display or link to services operated by third parties. We do not own, control, endorse, or assume responsibility for their content, accounts, availability, security, or practices. Your use of a third-party service remains governed by that service's terms and policies. You are responsible for complying with them and for having the rights needed to access any content.

We also use third-party service providers to operate and improve the Services, including PostHog for limited app analytics and native crash diagnostics, Supabase for Movie Mode, and website hosting and delivery providers. Their role and the information they process are described in our Privacy Policy. We may replace service providers or change how they are used as the Services evolve.

Third-party sites may change at any time, which can cause an Unspiral feature to stop working, display incorrectly, or become unavailable.

9. Acceptable use

You may not misuse the Services. Among other things, you may not:

• break the law, infringe rights, or encourage others to do so;
• probe, attack, overload, scrape, or interfere with the Services or their security;
• use automated means to access Movie Mode except through interfaces we provide;
• transmit malicious code or attempt to obtain another person's room or device information; or
• remove proprietary notices or misrepresent an affiliation with Unspiral.

10. Ownership and feedback

Unspiral and its original software, branding, design, and content are owned by us or our licensors and are protected by intellectual-property laws. Third-party names and marks belong to their respective owners. If you send feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation.

11. Changes, availability, and termination

We may modify, suspend, or discontinue part or all of the Services, and may update the app to account for iOS or third-party changes. We may restrict access when reasonably necessary to protect users, comply with law, or prevent misuse. You may stop using the Services at any time and delete the app.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR EFFECTIVE FOR ANY PARTICULAR WELLBEING GOAL.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSPIRAL AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply where prohibited by law.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless applicable consumer law gives you the right to bring a claim elsewhere, disputes will be brought in the state or federal courts located in California, and you consent to their jurisdiction.

15. Apple App Store terms

This section applies if you obtained Unspiral through Apple's App Store, and it prevails over anything else in these Terms that conflicts with it. Your licence to the app is granted under Apple's Standard End User License Agreement; where that agreement and these Terms conflict as to the app licence, the Standard EULA controls.

These Terms are with us, not Apple. These Terms are concluded between you and Momolith alone, not with Apple. We, not Apple, are solely responsible for Unspiral and its content.

Scope of licence. The licence granted in section 3 is a non-transferable licence to use Unspiral on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Unspiral may be accessed by other accounts associated with you through Family Sharing or volume purchasing.

Maintenance and support. We are solely responsible for providing any maintenance and support for Unspiral, as specified in these Terms or as required by law. Apple has no obligation to furnish any maintenance or support. Reach us at support@momolith.com.

Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Unspiral fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Unspiral.

Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Unspiral or your possession and use of it, including product liability claims, any claim that Unspiral fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, including in connection with Unspiral's use of the HealthKit and HomeKit frameworks, which it does not use.

Intellectual property claims. We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any third-party claim that Unspiral or your possession and use of it infringes that third party's intellectual property rights.

Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms. You must comply with applicable third-party terms of agreement when using Unspiral, including the terms of the third-party services described in section 8.

Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

16. Changes to these Terms

We may update these Terms. We will post the new version here, update the effective date, and provide additional notice when required. Continued use after an update takes effect means you accept the revised Terms.
